OnePay is a consumer fintech platform backed by Walmart and Ribbit Capital, offering banking, high-yield savings, credit cards, point-of-sale lending, investing, and crypto services. The Marketing Counsel role is a strategic legal partnership position supporting OnePay's fast-growing marketing organization. You will serve as the primary legal advisor to the Marketing, Brand, Design, Paid Media, and Product teams, providing real-time counsel that enables rapid, compliant campaign launches. Key responsibilities include: advising on advertising technology, privacy, and consumer data (CCPA/CPRA, state privacy laws, PII, ad tech tracking); structuring creator, influencer, and brand-collaboration agreements with FTC compliance; designing and reviewing rewards programs, sweepstakes, contests, and promotions with multi-state regulatory compliance; advising on affiliate and partner-marketing programs; supporting content production end-to-end (talent releases, music licensing, rights clearances); partnering on claim development and substantiation; and leveraging AI tools to accelerate contract review, workflow automation, and knowledge management while maintaining appropriate controls. The ideal candidate has 8+ years of legal experience (including 6+ years in marketing, advertising, or ad tech law), with demonstrated expertise in FTC Act compliance, UDAAP, endorsement rules, influencer marketing, affiliate programs, and advertising-related privacy. You should have a track record of advising C-suite executives, strong drafting and negotiation skills across vendor and partnership agreements, and proficiency with AI tools. Prior fintech or regulated-industry marketing experience is preferred. This role requires a practical, business-first mindset, comfort with ambiguity and fast-paced environments, and an ownership mentality that balances legal risk with commercial realities.
