Brex is seeking a Credit Card Counsel to serve as an embedded legal partner to engineering, product, and design teams building spend management software. In this role, you will advise on regulatory and commercial issues across credit card, lending, and fintech products—including data privacy, contracting, intellectual property, AI automation, and consumer/commercial protection requirements. You will translate complex regulatory, card network, and bank partner requirements into practical product decisions, helping teams move fast without compromising compliance. Working closely with cross-functional partners including privacy, security, compliance, marketing, sales, and partnerships, you'll provide strategic guidance from the earliest stages of ideation through product launch. Key responsibilities include: - Serve as embedded legal counsel to engineering, product, and design teams building spend management features (budgets, policies, approvals, audit and controls) - Provide pragmatic advice on regulatory and commercial implications of product architecture, data flows, automation, AI features, and integrations - Advise on credit, lending, and card network regulatory questions - Advise on software, data privacy, and product regulatory matters - Review product and marketing collateral, customer communications, and disclosures - Draft and maintain customer agreements, terms, disclosures, and feature-level terms - Support data handling, integration, and partner arrangements for product launches You'll work in a hybrid environment with a minimum of three coordinated days in the office per week (Monday, Wednesday, Thursday), plus up to four weeks per year of fully remote work. Required qualifications: 4+ years of combined law firm and technology/fintech company experience, ideally advising on credit card, lending, and commercial matters for regulated financial or technology products. Strong familiarity with federal, state, and international credit and lending laws (TILA/Regulation Z, ECOA/Regulation B, UDAP/UDAAP), card network rules (Visa, Mastercard, Amex, Discover), and required disclosures. Excellent written and verbal communication skills for both internal and external audiences. Ownership mentality and comfort with complex matters requiring sound judgment.
