Brex is seeking a Credit Card Counsel to serve as an embedded legal partner to engineering, product, and design teams building spend management software. In this role, you will advise on regulatory and commercial issues across credit card, lending, software, and fintech products—including data privacy, contracting, intellectual property, AI and automation, and consumer/commercial protection requirements. You will translate complex regulatory, card network, and bank partner requirements into practical product decisions, helping teams move fast without compromising compliance. Working closely with engineering, product, design, and cross-functional partners (privacy, security, compliance, marketing, sales, partnerships), you'll provide strategic guidance from the earliest stages of ideation through product launch. Key responsibilities include: - Serve as embedded legal counsel to product and engineering teams building budgets, policies, approvals, and audit/controls features - Advise on regulatory and commercial implications of product architecture, data flows, automation, AI features, and integrations - Provide guidance on credit, lending, and card network regulatory questions - Advise on software, data privacy, and product regulatory matters - Review product and marketing collateral, customer communications, and disclosures - Draft and maintain customer agreements, terms, disclosures, and feature-level terms - Support data handling, integration, and partner arrangements for product launches You'll need 4+ years of experience in law firms and/or technology/fintech companies, with expertise in credit card, lending, and commercial matters for regulated financial products. Familiarity with TILA/Regulation Z, ECOA/Regulation B, UDAP/UDAAP, card network rules (Visa, Mastercard, Amex, Discover), and required disclosures is essential. Strong written and verbal communication skills are critical for both internal guidance and external customer-facing documents. The role is based in Brex's New York City office with a hybrid arrangement requiring a minimum of three coordinated days in-office per week (Monday, Wednesday, Thursday), plus up to four weeks of fully remote work annually.
