Salary: USD 270,000 - 335,000 / annual
Brex is an intelligent finance platform serving tens of thousands of companies globally with corporate cards, banking, spend management, and AI-native automation. The Legal team provides strategic advice across the organization, protecting Brex and its customers while navigating a highly regulated fintech environment.
As Senior Counsel, Risk, you will own the legal response to high-stakes moments: disputes, incidents, collections, and regulatory inquiries. You will serve as the connective tissue between Legal, Compliance, Risk, Operations, and product teams, driving resolution of complex matters.
Key responsibilities include:
- Managing pre-litigation matters end-to-end: demand letters, customer/vendor/counterparty disputes, early case assessment, and outside counsel escalation
- Leading legal resolution of account and funds ownership disputes, including competing claims, deceased/dissolved account holders, business partner separations, and interpleader scenarios
- Overseeing collections strategy on delinquent commercial card and lending balances, managing collections agencies and outside counsel, ensuring compliance with applicable law and bank partner requirements
- Managing bankruptcy matters involving Brex customers and counterparties: proof of claim filings, automatic stay compliance, preference/clawback exposure, and recovery strategy in Chapter 7 and 11 proceedings
- Serving as legal lead on incidents company-wide, from intake through root cause analysis, coordinating cross-functional response and maintaining privilege
- Driving remediation programs: scoping affected populations, structuring remediation approaches, documenting completion
- Owning legal review and strategy for customer outreach related to incidents and remediations
- Preparing and managing responses to regulatory inquiries, examinations, and information requests in partnership with Compliance and banking/broker-dealer partners
- Supervising responses to subpoenas, civil investigative demands, and third-party legal process
- Building and improving playbooks, escalation frameworks, and reporting for consistent, rapid handling of recurring matters
- Advising product, operations, and support teams on reducing dispute and incident risk upstream
The role is based in Brex's New York City office with a hybrid model requiring a minimum of three coordinated days in-office per week (Monday, Wednesday, Thursday), plus up to four weeks per year of fully remote work.
Requirements:
- Juris Doctor (JD) and active bar membership in good standing in at least one U.S. jurisdiction
- 6+ years of experience as an attorney, including at least 3 years focused on litigation/commercial disputes, creditors' rights/collections, bankruptcy, regulatory investigations/enforcement, or incident response
- Experience owning pre-litigation disputes end-to-end, including demand letters, early case assessment, and decisions on outside counsel escalation
- Working knowledge of fintech regulatory landscape: state money transmission, UDAAP, Reg E and Reg Z, BSA/AML, and bank partnership models
- Demonstrated ability to run a high-volume, high-stakes docket independently with excellent judgment on resolution, escalation, and litigation decisions
- Strong drafting instincts for customer-facing and regulator-facing communications where precision and tone matter
- Calm, structured approach under pressure with bias toward action and clear ownership
- Low ego, high accountability, comfort operating cross-functionally with Compliance, Risk, Operations, and Engineering/Product/Design teams
Nice to have:
- 3+ years as in-house attorney at fintech, bank, broker-dealer, or payments company
- Experience responding to bank regulatory examinations (OCC, Federal Reserve)
- Broker-dealer regulatory experience (FINRA/SEC examinations, customer arbitrations, Rule 4530 reporting, SEC enforcement)
- Experience managing collections agencies or recovery counsel in Chapter 7/11 proceedings
- Experience with account ownership and beneficiary dispute frameworks
- Experience managing subpoena and third-party legal process response under RFPA, GLBA, and similar financial privacy frameworks
