Cloaked is a consumer privacy and identity platform backed by $375M in Series B funding. The company has protected 10M+ identities and removed 1B+ records from data brokers. Cloaked is now building AI-native privacy solutions, including autonomous agents that monitor and defend users' digital footprints.
You will serve as Product Counsel, embedded with Product, Engineering, Compliance, and business teams to shape the next generation of AI-native privacy, identity, and financial-services products. This is a product-lawyer role, not a traditional legal reviewer. You will operate from ideation through launch, translating legal and regulatory requirements into practical product decisions.
Key responsibilities include:
**Product & AI Counseling:** Partner directly with Product, Engineering, Design, and Compliance on AI-enabled privacy, identity, and financial-services products. Advise on novel legal and regulatory questions involving AI-driven workflows, agentic experiences, automated decisioning, personalization, data use, and consumer-facing claims. Distinguish hard requirements from judgment calls and help the business make calibrated risk decisions. Counsel on adjacent privacy, cybersecurity, AI governance, marketing, and consumer-protection matters in a lean legal team.
**Financial Services & Payments:** Advise on consumer payments and credit-card regulatory requirements, including Regulation E, Regulation Z, GLBA, UDAAP/UDAP, FCRA, BSA/AML, prepaid access, money-transmission, and Nacha requirements. Review and challenge financial-services compliance analyses; ensure regulatory requirements translate into product flows, disclosures, policies, procedures, and operational workflows. Lead legal work across the Cloaked Pay ecosystem, including issuing-bank/BIN-sponsor relationships, program managers, processors, tokenization partners, cardholder terms, funding and settlement structures, disputes, and vendor arrangements.
**Commercial & Strategic Partnerships:** Own and negotiate product-enabling agreements, including enterprise and end-customer agreements, AI/model and data-provider agreements, MSAs, SOWs, order forms, DPAs, NDAs, procurement agreements, partnerships, technology integrations, and vendor contracts. Partner with Product, Sales, Partnerships, and Engineering to move launches and agreements forward efficiently.
**Corporate & General Legal:** Support corporate legal work, including entity formations, corporate records and maintenance, filings, governance support, and coordination with outside counsel.
The role is based in NYC with a hybrid model. The office includes amenities such as a gourmet cafe, cocktail bar, and rooftop work area. Cloaked offers flexible work arrangements and the ability to work remotely as needed.
**Requirements:**
- Approximately 7–10 years of legal practice with meaningful product-counseling experience and strong exposure to financial-services, payments, banking, credit-card, fintech, privacy, or AI-enabled technology products.
- J.D. from an accredited law school and active bar admission in good standing.
- Deep, hands-on consumer financial-services regulatory experience; ability to apply rules to live products and translate them into practical product and compliance decisions.
- Strong payments or card experience, ideally involving card issuing, consumer credit, virtual cards, payment processing, sponsor-bank/program-manager relationships, or comparable payments infrastructure.
- Strong commercial contracting ability across enterprise, procurement, vendor, partnership, and technology agreements; comfort owning negotiations.
- Product-lawyer judgment: ability to sit with product managers and engineers, understand proposed features and technical flows, identify legal issues early, and give clear recommendations about responsible building and launch.
- Comfort operating in a startup environment where Product and Engineering move quickly, the legal team is lean, and practical answers are valued over academic ones.
**Nice to have:**
- In-house product-counsel experience at a fintech, bank, card issuer, payments company, AI company, consumer technology company, or platform business with regulated product exposure.
- Experience supporting consumer credit cards, BNPL/installment lending, consumer payments, issuing, acquiring, or similar financial products.
- Prior law-firm, regulatory, or government experience in consumer financial services, paired with desire to operate hands-on in a fast-moving company.
- Experience counseling on privacy, cybersecurity, AI governance, data use, automated systems, or consumer-protection issues, particularly where they intersect with financial products and consumer data.
- Corporate experience such as entity formation, corporate maintenance, governance, or related filings.
